Uber Wins Injunction and Can Now Operate in Federal Airports; Key Decision for Los Cabos

Mexico City.- The ride-sharing platform Uber has obtained a definitive injunction (amparo) that allows it to operate legally in all federal zones of the country, a decision with direct and significant implications for the Los Cabos International Airport, the main entry point to Baja California Sur's most important tourist destination.

This ruling, issued by the Third Collegiate Tribunal in Administrative Matters, represents a milestone in a long-standing dispute over the legality of the tech application's services within air, maritime, and border terminals.
Historically, the Los Cabos Airport has been a point of friction. Platform drivers faced fines and were prohibited from picking up passengers, as the National Guard and airport authorities considered the activity a violation of the exclusivity held by federal taxi concessions.
The judicial resolution is clear: no federal authority can now prohibit, fine, or prevent Uber from offering its pickup and drop-off services on airport access roads, as long as the transaction was initiated through the application.
For Baja California Sur, and specifically for Los Cabos and La Paz, this transforms the tourism mobility landscape. The Los Cabos Airport receives millions of international visitors annually, many of whom are familiar with the platform and expect to use it upon arrival.
This decision fosters competition and offers tourists an additional transportation alternative to taxis and tourist shuttles, which could diversify price and service options.
The ruling aligns with a vision of modernization and openness to new technologies in the country's key infrastructure, ensuring that regulatory frameworks adapt to the realities of the digital market and promote free economic competition.
